The rules of the website (hereinafter referred to as the Rules)
General Provisions
1.1. These rules define the procedure and conditions for the use of information, news, and other materials posted on the meteorologist.pro website (hereinafter referred to as the "Site Administration") located at meteorologist.pro, the news section of the website located at site (hereinafter the specified section of the website is referred to as the “Site”), as well as the rules for using materials by the Site and the procedure for interacting with the Site Administration.
1.2. Any materials posted on the Site are intellectual property items (objects of copyright or related rights, as well as rights to means of individualization). The rights of the Site Administration to these materials are protected by the law regarding the rights on the results of intellectual activity.
1.3. The use of materials posted on the Site is allowed only with the written consent of the Site Administration or other copyright holder directly indicated on a specific material posted on the Site or in the immediate vicinity of the specified material.
1.4. The right to use and permit the use of materials posted on the Site and owned by copyright holders other than the Site Administration is allowed with the permission of such copyright holders or under the conditions established by such copyright holders. None of the provisions of these Rules entitles third parties to use the materials of copyright holders directly indicated on a specific material posted on the Site or in the immediate vicinity of the specified material.
1.5. These Rules apply to the following users: news agencies, electronic and print media, any individuals and legal entities, as well as individual entrepreneurs (hereinafter referred to as the "Users").
Use of materials. Uses
2.1. The use of the Site materials shall be understood to mean reproduction, distribution, public display, broadcasting, cablecasting, translation, processing, making publicly available, and other methods of use stipulated by the current legislation of Ukraine.
2.2. It is not allowed to use the Site materials without obtaining permission from the Site Administration.
2.3. It is prohibited to make any changes and/or additions to the materials of the Site and to process the materials in any way.
2.4. The use of the Site materials is carried out based on written agreements with the Site Administration or written permission issued by the Site Administration.
2.5. Any use (non-contractual/without permission) of photo, graphic, video, audio and other materials posted on the Site and owned by the Site Administration and other copyright holders (third parties) is prohibited.
2.6. The cost of using each specific material or issuing permission for its use is subject to negotiation between the User and the Site Administration in each specific case.
2.7. If it is necessary to use the Site’s materials that belong to third parties (copyright holders other than the Site Administration as expressly indicated on such materials or in their immediate vicinity), Users must contact the copyright holders to obtain permission to use the materials.
Obligations of Users when using the materials of the Site
3.1. It is required to provide a link to the Site when using its materials with the permission of the Site Administration for any purpose. The link is provided in the following form:
3.1.1. Users are obliged to indicate the source — the Meteo website in each case of using materials in printed publications or in other forms on tangible media.
3.1.2. Users are required to place a hyperlink to the Site — in each case of using the materials on the Internet or in other electronic forms, not on tangible media. The hyperlink must be active and direct, allowing the User to go to a specific page of the Site from which the material is borrowed.
3.1.3. The User must place the source link or hyperlink specified in paragraphs. 3.1.1 and 3.1.2 of these Rules at the beginning of the text used and directly under the used audio, video, photo, and graphic material of the Site Administration. The font size of the source link or hyperlink must not be smaller than the font size of the text where the materials of the Site are used or the font size of the User's text accompanying the audio, video, photo, and graphic materials of the Site. The color of the link must be identical to the colors of links used on the Site and must be visible to the User.
3.1.4. The use of the Site’s materials obtained from secondary sources (from copyright holders other than the Site Administration as expressly indicated on such materials or in close proximity to them) is possible only by providing reference to these sources and, if specified by such sources (copyright holders), with their permission.
3.2. It is not allowed to process an original material (work) taken from the Site, in particular, to reduce it and process it in other ways leading to the distortion of its meaning, among other things.
3.3. When using materials of the Site with the permission of the Site Administration for any purpose and when using informational materials and news of the Site, the Users’ websites and RSS feeds must not indicate the release time of the informational materials and news as identical or prior to the time of their release on the Site.
Rights to Third Party Materials, Claims Settlement
4.1. The Site’s materials that belong to third parties are posted either with the permission of the copyright holder received by the Site Administration or, if such use is not expressly prohibited by the copyright holder, following the legislation of Ukraine for informational purposes with the obligatory indication of the author’s name and the source of the materials.
4.2. If the indication of authorship to materials under paragraph 4.1 of these Rules contains an error, or in the case of using the materials with an alleged or real violation of the rights of third parties, or in other controversial cases of using intellectual property items posted on the Site, including when the rights of a third party are somehow violated by using the Site, the following scheme for settling claims of third parties to the Site Administration is applied:
4.2.1. A claim is sent to the Site Administration by e-mail at [email protected], containing information about the intellectual property item that belongs to the claimant and is used illegally through the Site or in violation of the terms of use or in breach of the rights of the claimant as the owner of the exclusive right to the intellectual property item posted on the Site in any other way through the Site, with documents confirming the claimant’s eligibility, data on the copyright holder, and a copy of the power of attorney for acting on behalf of the copyright holder if the person submitting the claim is not the head of the copyright holder company or the individual copyright holder. The claim must also indicate the address of the Site’s page that contains the data infringing the rights and provide a full description of the essence of the infringement. The claimant also undertakes, within one day from the date of sending the claim via e-mail, to send the written claim to the Site Administration at the address: Ukraine, 02094, Kyiv, ul. Gnata Khotkevicha 8, office 205.
4.2.2. The Site Administration undertakes to process a properly executed claim within at least 5 (five) business days from the date of receiving it by e-mail but, in any event, within 5 (five) business days from the date of receiving the claim in writing. The Site Administration undertakes to notify the claimant of the results of the consideration by sending an e-mail to the address indicated by the claimant and to send a written response to the address indicated by the claimant (if such an address is not specified, the Site Administration disclaims all responsibility for providing a written response to the claim). In particular, the Site Administration has the right to request additional documents, certificates, and data confirming the legitimacy of the claim. If the claim is recognized legitimate, the Site Administration will take all possible measures necessary to stop the violation of the claimant's rights and settle the claim.
4.2.3. In any case, the Site Administration takes all possible measures to satisfy the justified claims of third parties as soon as possible and strives to resolve all disputes at the earliest.
Miscellaneous
5.1. The Site Administration reserves the right to change these Rules unilaterally at any time without notifying the Users. Any changes will be posted on the Site. The changes come into force from the moment they are published on the Site.

5.3. Regarding the use of materials on the Site, the parties are guided by the provisions of Ukrainian legislation in everything that is not regulated by these Rules.
